General terms and conditions of business
The conditions for booking, payment and your stay in the Bavaria City Hostel.
Status: 10. October 2026
Contractual partner: Dominik Ostheimer · Sole proprietorship Bavaria City Hostel - Design Hostel Füssen Reichenstraße 15 87629 Füssen
1. Scope
1.1 These terms and conditions apply to contracts for the rental of hostel rooms for accommodation as well as all other services and deliveries provided by the hostel to the customer in this context (hostel accommodation contract). The term “hostel accommodation contract” includes and replaces the following terms: accommodation, guest accommodation, hostel, hostel room contract.
1.2 Subletting or re-letting the rooms provided, and using them for purposes other than accommodation, require the hostel’s prior consent in text form. § 540 paragraph 1 sentence 2 BGB is excluded insofar as the customer is not a consumer.
1.3 The customer's general terms and conditions only apply if this has been expressly agreed upon in advance.
2. Conclusion of contract, partners and statute of limitations
2.1 The contract is concluded when the hostel accepts the booking request. A booking confirmation can be made in text form, for example by email.
2.2 The contractual partners are Dominik Ostheimer as the operator of the Bavaria City Hostel and the customer. If a third party books as a representative for the customer, this alone does not constitute the representative's own liability. A personal liability requires an express and separate declaration to this effect. The legal rules regarding representation remain unaffected.
2.3 The statutory limitation periods apply to claims arising from the hostel accommodation contract.
3. Services, prices, payment and offsetting
3.1 The hostel is obliged to keep the rooms booked by the customer available and to provide the agreed services.
3.2 The customer is obliged to pay the hostel's agreed or applicable prices for the room rental and the other services used by him. This also applies to services ordered by the customer directly or through the hostel, which are provided by third parties and paid for by the hostel.
3.3 The agreed prices include taxes and local charges applicable at the time the contract is concluded. Local taxes that are owed by the guest according to local law, such as tourist tax, are not included. If there is a change in the statutory sales tax or the introduction, change or abolition of local taxes on the subject of the service after the contract has been concluded, the prices will be adjusted accordingly. For contracts with consumers, this only applies if the period between conclusion of the contract and fulfillment of the contract exceeds four months.
3.4 Any reduction in the number of rooms, the scope of services or the length of stay requested by the customer requires an agreement with the hostel. Any impact on the price will be expressly agreed upon before the change; There will be no unilateral subsequent price increase.
3.5 Invoices without an agreed due date are payable without deduction within five days of receipt. Agreed payment dates remain relevant. The statutory provisions apply to late payments.
3.6 The hostel is entitled to demand an appropriate advance payment or security, for example in the form of a credit card guarantee, from the customer upon conclusion of the contract or thereafter, taking into account the legal provisions. The amount of the advance payment and the payment dates can be agreed in text form in the contract. If the customer defaults on payment, the statutory regulations apply.
3.7 In justified cases, for example the customer's payment arrears or an extension of the scope of the contract, the hostel is entitled to demand an advance payment or security deposit within the meaning of the above paragraph 3.6 or an increase in the advance payment or security deposit agreed in the contract up to the full agreed remuneration, even after the contract has been concluded until the start of the stay.
3.8 The hostel is also entitled, at the beginning and during the stay, to demand an appropriate advance payment or security deposit from the customer within the meaning of the above paragraph 3.6 for existing and future claims arising from the contract, unless such payment has already been made in accordance with the above paragraph 3.6 and/or paragraph 3.7.
3.9 The statutory provisions apply to offsetting and retention rights.
3.10 Payment is possible in cash, with EC card, credit card or bank transfer. The following credit card regulations also apply to online reservations.
3.11 A valid credit card and its expiry date are required to make a reservation through our online booking system. The details are sent to our channel manager Myallocator.com and checked. To secure the booking, we pre-authorize the card up to six weeks before the arrival date for the full reservation amount, including agreed additional costs and the statutory tourist tax charged by the city of Füssen for the planned stay. This pre-authorization initially only reserves the amount; the card is not yet charged.
3.12 For online bookings through our website, we charge the credit card provided before arrival for the full booking amount, including agreed additional costs and the tourist tax for the planned stay, once the agreed free cancellation period has expired. If the arrival date is already within the period when cancellation incurs a charge at the time of booking, the card is charged immediately after the booking is confirmed. In the event of cancellation or no-show, the conditions in clause 4 apply. Amounts already paid are credited; any amount exceeding the cancellation charges owed is refunded. This includes tourist tax collected in advance that is not payable because the stay did not take place. Any different payment and cancellation conditions are expressly agreed at the time of booking.
3.13 An online reservation without a valid credit card is not possible. If you don't have a credit card, send us a booking request using our contact form. In this case, the booking amount must be transferred in advance after the booking has been confirmed. Please also inquire about group stays using the contact form; We will take care of the booking for you. For group bookings of ten or more people, the payment terms according to number 3.14 apply.
3.14 For group bookings of ten or more people, a deposit of 25% of the price of the entire booking is due within five working days of the booking date. The final payment is due two months before the arrival date.
3.15 Note on debit cards: With a debit card, for example Visa Debit or Debit Mastercard, the pre-authorization in online banking or account statement may already look like a debit or be displayed as a reserved amount. This display does not mean that we have collected the amount as payment.
3.16 Note on validity: If a pre-authorization is not converted into a payment within its validity period, it will automatically expire and the reserved amount will be released again. The duration depends on the card, the card-issuing bank and the payment provider. If you cancel free of charge on time, we will not collect the reserved amount; Any existing pre-authorization also expires automatically. There will be no separate confirmation or cancellation of authorization by us for this automatic expiry.

4.1 The following conditions apply to cancellations unless different conditions were expressly agreed at the time of booking. Statutory rights to withdraw from or terminate the contract remain unaffected. Accommodation contracts for a specific date or period generally have no statutory right of withdrawal under § 312g para. 2 No. 9 BGB. The agreed cancellation options are distinct from that right.
4.2 If a deadline for free cancellation has been agreed, the customer may cancel free of charge until that deadline. Cancellation must be communicated to the hostel in text form, for example by email. Receipt before the deadline is decisive. Individual agreements and statutory rights remain unaffected.
4.3 If there is no right to cancel free of charge and the booked service is not used, the statutory provisions and the following cancellation conditions apply. Income from re-letting and saved expenses must be credited. The customer may always demonstrate that no claim, or a substantially lower claim, has arisen. The same overnight accommodation will not be charged twice.
4.4 For bookings through our website for 1 to 9 people, cancellations and changes are free of charge until seven days before the agreed arrival date. For arrivals from 01.06. to 05.09. inclusive and from 24.12. to 02.01. inclusive, a deadline of 21 days before arrival applies instead of the regular deadline. Cancellations and changes after the applicable deadline, as well as no-shows, are charged at 90 % of the total booking amount. Income from re-letting and saved expenses may be credited, and the customer may demonstrate that no claim, or a substantially lower claim, has arisen under clause 4.3. Charges incurred only for an actual stay are not included in cancellation charges.
4.5 For group bookings of ten or more people, cancellations and changes are free of charge until 45 days before the agreed arrival date. After that, but at least 30 days before arrival, cancellations and changes are charged at 60 % of the price of the entire booking. Later cancellations and changes, as well as no-shows, are charged at 90 % of the price of the entire booking. The customer may demonstrate that no claim has arisen or that the amount claimed is too high. The crediting of income from re-letting and saved expenses under clause 4.3, and the exclusion of charges incurred only for actual stays under clause 4.4, remain unaffected.
4.6 It is recommended that the customer take out travel cancellation insurance.
5. Cancellation of the hostel
5.1 If an advance payment or security deposit agreed or requested in accordance with Section 3.6 and/or Section 3.7 is not made even after a reasonable grace period set by the hostel has expired, the hostel is also entitled to withdraw from the contract.
5.2 The hostel can withdraw from the contract or terminate it if the legal requirements for this are met, in particular if the service becomes impossible for reasons for which the hostel is not responsible or if there is an important reason. Legal requirements such as a necessary warning or setting of a deadline and the customer's legal claims remain unaffected.
6. Room preparation, handover and return
6.1 You are only entitled to a specific room if this has been expressly agreed. The booked room category and the agreed features remain binding.
6.2 Booked rooms are available from 14:00 on the agreed arrival day. An earlier provision requires an agreement.
6.3 Your personal door code allows you to arrive independently at any time, including after 21:00. If you arrive late, personal check-in at reception takes place the next morning. A late arrival alone does not automatically remove your entitlement to the booked room. Statutory rights and expressly agreed booking conditions remain unaffected.

7. Liability of the hostel
7.1 The statutory liability rules apply to damages. Liability for damage to life, body or health as well as for intent or gross negligence is not limited. There is no provision for personal collection, allocation or ongoing supervision of luggage by staff with this self-service deposit. Each guest is responsible for their own drop-off and pick-up and may only take their own luggage or luggage with the express permission of the authorized person. Please lock your luggage, keep escape routes and access to the washing machine and dryer clear and do not leave valuables unattended. Separate personal storage requires an express agreement; Legal obligations to accept valuables remain unaffected. The hostel's legal liability, in particular for items brought in according to §§ 701 ff. BGB and for culpable breaches of duty, is not excluded or limited by this regulation.
7.6 Washing machine and dryer in the laundry and luggage room are available to guests for self-service. The hostel does not provide a laundry or cleaning service and does not take over the textiles for treatment or storage. Guests are responsible for selecting appropriate textiles, sorting laundry, choosing the program, temperature and detergent, and removing their laundry in a timely manner. The care labels on the textiles, the operating instructions for the devices and the instructions in the washroom must be observed. Textiles that are not suitable for machine washing or tumble drying must not be treated accordingly. The statutory rules apply to damage caused by inappropriate treatment or incorrect operation for which the guest is responsible; Error-free cleaning or drying of every textile is not guaranteed. Please report any malfunctions immediately and stop using a device that is noticeably defective. The hostel's statutory safety, maintenance and liability obligations, particularly in the event of culpable breaches of duty or equipment defects, remain unaffected.
